Privacy Policy

How we collect, use, and protect your information — including the elevated protections we apply to mobile phone numbers and SMS opt-in data under A2P 10DLC carrier guidelines.

Overview

Level Up Acres LLC ("we", "us", "our") is a real estate investment company based in Indianapolis, Indiana. This Privacy Policy describes how we collect, use, share, and protect information when you visit levelupacres.com, contact us, request a cash offer, schedule a call, or otherwise interact with our services (collectively, the "Services").

By using our Services, you agree to the practices described here. If you do not agree, please do not use the Services. This policy is written in plain language so you can understand what's happening with your data.

Information We Collect

We collect information you give us directly, information about your property, and a limited amount of technical information about how you use our website.

Information You Provide

  • Contact details — your name, email address, phone number, and mailing address.
  • Property information — the address, condition, occupancy status, asking price, and timeline for any property you wish to sell.
  • Communications — the content of messages, emails, voicemails, and texts you send us.
  • Consent records — whether you have opted in to SMS communications, the date and time of consent, the language shown to you, and the IP address used.

Information Collected Automatically

  • Device and browser data — IP address, browser type, operating system, device type, referring URL, and pages viewed.
  • Usage data — interactions with our website (form submissions, button clicks, time on page) used to improve user experience.
  • Cookies and similar technologies — see the dedicated Cookie Policy below.

Information from Third Parties

We may obtain limited property details from publicly available sources such as county property records, the Marion County Assessor, and the Indiana real estate database. We do not buy or rent personal contact lists.

How We Use Information

We use your information only for purposes that are reasonable, expected, and necessary to provide our Services:

  • To prepare and present cash offers for your property.
  • To respond to your inquiries, questions, and contact form submissions.
  • To schedule and follow up on property review calls and appointments.
  • To send transactional communications (offer details, appointment confirmations, closing logistics).
  • To send SMS messages — only if you have explicitly opted in (see the SMS Messaging Policy).
  • To comply with legal obligations, contractual requirements, and applicable real estate regulations.
  • To detect, prevent, and address fraud or security issues.
  • To improve our website, marketing, and customer experience using aggregate, non-identifying analytics.

SMS & Phone Number Privacy (A2P 10DLC)

Phone numbers and SMS opt-in data receive heightened protection under United States carrier guidelines (A2P 10DLC) and our own policies.

Our SMS Promise

Mobile phone numbers and SMS opt-in information collected by Level Up Acres LLC are never shared with, sold to, or rented to third parties or affiliates for marketing or promotional purposes. This applies to all consent gathered through any form, page, or interaction with our Services.

What We Collect for SMS

  • Your mobile phone number.
  • Whether you opted in (the dedicated SMS consent checkbox was actively checked).
  • The timestamp of consent, the IP address used, the URL of the page where consent was given, and the exact consent language displayed.
  • Records of messages sent and received, opt-out requests, and HELP responses.

How Long We Keep It

We retain SMS consent records for as long as you remain opted in, plus a reasonable period afterward (typically four years) for compliance with the Telephone Consumer Protection Act (TCPA) and carrier requirements.

Not a Condition of Service

SMS consent is never a condition of receiving a cash offer, scheduling a call, selling your property to us, or using any of our other Services. You can decline SMS and still use everything we offer.

Sharing & Disclosure

We do not sell your personal information. We share information only in the following limited circumstances:

  • Service providers — vendors who help us operate our business (CRM, hosting, title companies, attorneys, payment processors). These providers are bound by contract to use your information only for the purposes we specify and to keep it confidential.
  • Transaction parties — when you choose to sell us a property, we share necessary information with title companies, attorneys, and closing agents to complete the transaction.
  • Legal requirements — when required by law, court order, subpoena, or to protect our legal rights, property, or safety, or the rights and safety of others.
  • Business transfers — if Level Up Acres LLC is acquired, merged, or sells substantially all of its assets, your information may be transferred (subject to the same protections described in this policy).

Exception — Mobile and SMS opt-in data: as described above, mobile phone numbers and SMS opt-in information are excluded from sharing with third parties or affiliates for marketing purposes under any circumstance.

Data Security

We take reasonable administrative, technical, and physical safeguards to protect your information against loss, theft, misuse, and unauthorized access. This includes encrypted data transmission (HTTPS), access controls on our internal systems, and limited employee access on a need-to-know basis.

However, no method of transmission over the internet or method of electronic storage is 100% secure. If we become aware of a security incident affecting your data, we will notify you in accordance with applicable law.

Your Rights & Choices

You have the following rights regarding your personal information:

  • Access — request a copy of the information we hold about you.
  • Correction — request that we correct inaccurate or incomplete information.
  • Deletion — request deletion of your information, subject to legal recordkeeping obligations.
  • Opt-out of SMS — reply STOP to any text or contact us using the methods in the SMS Messaging Policy.
  • Opt-out of email marketing — click the unsubscribe link in any marketing email.
  • Do Not Call — request to be added to our internal Do Not Call list.

To exercise any of these rights, contact us at [email protected]. We will respond within 30 days.

Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page. If we make material changes, we will provide more prominent notice. Your continued use of the Services after a change becomes effective constitutes your acceptance of the revised policy.

Contact & Data Requests

For SMS-specific concerns, please mark your message "SMS / 10DLC" in the subject line so it routes to the right team.

Cookie Policy

What cookies we use, why we use them, how long they last, and how you can control them.

What Are Cookies?

Cookies are small text files placed on your device (computer, phone, tablet) when you visit a website. They allow the site to recognize your device on return visits, remember your preferences, and provide essential functionality. We also use similar technologies such as web beacons, pixels, local storage, and session storage — collectively referred to as "cookies" in this policy.

Cookies do not, on their own, identify you personally. They identify your browser and device. When combined with other information you provide, cookies can be linked back to you as an individual.

Categories of Cookies We Use

Essential Required for the website to function — form submission, navigation, security. These cannot be disabled. Typical retention: session to 12 months.
Functional Remember choices you make to improve your experience — saved location, last-viewed property type, language preference. Typical retention: 6–12 months.
Analytics Help us understand which pages are visited, how visitors navigate, and where they come from. Aggregated and de-identified where possible. Typical retention: 14–26 months.
Advertising Used by partners such as Google Ads and Meta Ads to measure ad performance and show relevant ads on other sites. Typical retention: 30–90 days.

Third-Party Cookies

Some cookies on our site are placed by third-party services we use, such as Google Analytics, Google Ads, Meta (Facebook) Pixel, and our customer relationship management software. These third parties have their own privacy and cookie policies, which we do not control.

We never permit third-party cookies to associate your mobile phone number or SMS opt-in data with their advertising profiles. See the SMS & Phone Number Privacy section above.

How to Control Cookies

  • Browser settings — every major browser (Chrome, Safari, Firefox, Edge) lets you block or delete cookies.
  • Opt-out tools — visit youradchoices.com or optout.networkadvertising.org to opt out of interest-based advertising from participating networks.
  • Do Not Track (DNT) — we recognize browser DNT signals where technically practical.
  • Disable JavaScript — disables many but not all tracking technologies.

Disabling essential cookies may break parts of the website (forms, navigation). Disabling analytics or advertising cookies will not affect the functionality of the site.

Changes to This Cookie Policy

We may update this Cookie Policy as our tools and partners change. The "Last Updated" date at the top of the page reflects the current version. Material changes will be highlighted on the page or via a banner notice.

Terms & Conditions

The legal agreement between you and Level Up Acres LLC governing your use of our website and services. Specific SMS messaging terms are in Part 05.

These Terms form a binding agreement between you and Level Up Acres LLC, an Indiana limited liability company.

Description of Services

Level Up Acres LLC is a real estate investment company that purchases residential and select commercial properties in Indianapolis, Indiana, and surrounding areas. Through our website you can submit information about a property you wish to sell, schedule a property review call with our team, contact us with general questions, and learn about our process, service areas, and history.

We are not a real estate brokerage, agent, or attorney. We act as principal — we buy properties directly with our own funds rather than listing them on behalf of others.

Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract to use our Services. By using the Services, you represent that you meet these requirements and that all information you provide is accurate and complete. If you are submitting information about a property on behalf of another person or entity, you represent that you have the legal authority to do so.

Cash Offers & Transactions

Any cash offer presented by Level Up Acres LLC is:

  • Non-binding until reduced to a written purchase agreement signed by both parties.
  • Subject to property inspection and verification of the information you provided. Material discrepancies may result in an adjusted or withdrawn offer.
  • Conditional on clear title being delivered at closing, free of liens or encumbrances that were not disclosed and accepted.
  • Subject to local laws governing real estate transactions in Indiana.

You are under no obligation to accept any offer we present. We are under no obligation to make an offer on any property.

Intellectual Property

All content on this website — including text, graphics, logos, photographs, illustrations, and software — is the property of Level Up Acres LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may view and download content for personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works without our prior written consent. The Level Up Acres name and logo are trademarks of Level Up Acres LLC.

Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties to the fullest extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing on this website constitutes legal, tax, financial, or real estate advice. You should consult appropriate professionals before making decisions about your property.

Limitation of Liability

To the maximum extent permitted by law, Level Up Acres LLC and its officers, members, employees, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising under these Terms shall not exceed the greater of (a) one hundred U.S. dollars ($100), or (b) the amount you have paid us in the six months preceding the claim (which, for most users, is zero).

Indemnification

You agree to indemnify, defend, and hold harmless Level Up Acres LLC and its officers, members, employees, agents, and affiliates from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your violation of any law or the rights of a third party, or information you submit that is false, misleading, or that you did not have the right to submit.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of law principles. Any dispute arising under or related to these Terms shall be brought exclusively in the state or federal courts located in Marion County, Indiana, and you consent to the personal jurisdiction of those courts.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

Part 04 of 08

Part 06 of 08

Anti-Spam Policy

Our commitments under CAN-SPAM, TCPA, and A2P 10DLC — and what to do if you ever receive an unwanted message from us.

Our Commitment

Level Up Acres LLC does not engage in spam, mass unsolicited messaging, or deceptive marketing across any channel — email, SMS, phone, mail, or direct message. We believe a respectful, opt-in approach is the only sustainable way to build trust with property owners.

Email Anti-Spam (CAN-SPAM)

All marketing emails from Level Up Acres LLC comply with the federal CAN-SPAM Act of 2003 and applicable state laws. Specifically, our emails:

  • Use accurate "From," "To," and "Reply-To" addresses that identify Level Up Acres LLC as the sender.
  • Use truthful, non-deceptive subject lines.
  • Clearly identify any commercial message as an advertisement when required.
  • Include a valid physical postal address.
  • Provide a clear, conspicuous, working unsubscribe mechanism (one click or simple reply).
  • Honor opt-out requests within 10 business days, in most cases within 24 hours.

We never use harvested email lists, deceptive headers, hidden tracking, or sender impersonation.

SMS Anti-Spam (TCPA & A2P 10DLC)

Our SMS messaging program complies with the federal Telephone Consumer Protection Act (TCPA) and the carrier-enforced A2P 10DLC framework. Concretely:

  • We send SMS messages only to recipients who have actively opted in via the dedicated, unchecked consent box on our website or by other express written consent.
  • The full SMS Messaging Policy is presented before consent is captured.
  • STOP and HELP keywords are honored on every message and every short code or long code we operate.
  • We do not send messages outside reasonable hours (typically 8:00 AM – 9:00 PM in the recipient's local time zone, except for replies and time-sensitive transactional messages).
  • We do not share opt-in data with third parties or affiliates for marketing purposes, ever.
  • We do not use SMS for cold outreach, "wholesaler blast lists," or property-acquisition spam.

Phone Call Practices

We respect Do Not Call registry rules and our internal Do Not Call list. We do not engage in robocalls. Outbound calls are made by real team members, during reasonable hours, to people who have either contacted us first, provided their number through a form, or explicitly given verbal or written permission for follow-up.

How to Report Spam

If you ever receive a message from Level Up Acres LLC that you believe is spam, unsolicited, or that you did not opt in to, we want to know immediately:

Please forward or screenshot the message, including timestamps and sender ID, so we can investigate. We treat every abuse report seriously and respond within two business days.

Impersonation & Phishing

If you receive a message claiming to be from Level Up Acres LLC that asks for sensitive information (Social Security numbers, bank credentials, wire transfers to unfamiliar accounts, gift card codes), assume it is fraudulent and report it. We will never ask for such information by text message or unsolicited email.

Reporting to Authorities

You can also report SMS spam by forwarding the message to 7726 (SPAM) on most U.S. carriers, file complaints with the Federal Trade Commission at reportfraud.ftc.gov, or report unwanted calls at donotcall.gov.

Part 07 of 08

Fair Housing

Our commitment to Equal Housing Opportunity and compliance with all federal, state, and local fair-housing laws.

Equal Housing Opportunity

Level Up Acres LLC is an Equal Housing Opportunity company. We are committed to the letter and spirit of U.S. policy for the achievement of equal housing opportunity throughout the nation. We do not discriminate in the purchase, sale, financing, or negotiation of real estate on any basis prohibited by law.

Federal Fair Housing Act

We comply with the federal Fair Housing Act (42 U.S.C. §§ 3601 et seq.), the Equal Credit Opportunity Act, and all related federal regulations. These laws prohibit discrimination in housing-related transactions based on:

  • Race
  • Color
  • Religion
  • National origin
  • Sex (including gender identity and sexual orientation)
  • Familial status (including children under 18 and pregnant individuals)
  • Disability

Indiana & Local Protections

In addition to federal law, we follow Indiana state fair-housing requirements and any applicable Marion County or City of Indianapolis ordinances. Where local law provides additional protected classes (such as age, ancestry, military or veteran status, or source of income), those protections apply equally to our practices.

How This Applies to Our Practice

As a cash buyer, our offers are based exclusively on objective property characteristics — location, condition, comparable sales, square footage, lot size, repairs needed, and similar factors. We do not make offers conditional on the seller's personal characteristics or demographic profile. We extend the same diligence, transparency, and respect to every property owner we work with.

Advertising

All advertising, marketing materials, website content, and direct outreach from Level Up Acres LLC are intended to comply with fair-housing advertising rules. We avoid language that could be interpreted as preferring, limiting, or discriminating against any protected class. If you ever see content of ours that you believe violates this commitment, please notify us at [email protected].

Reporting Discrimination

If you believe you have been treated unfairly by anyone in connection with a housing transaction, you have recourse:

  • HUD (federal): File a complaint at hud.gov/fairhousing or call 1-800-669-9777 (TTY: 1-800-927-9275).
  • Indiana Civil Rights Commission: in.gov/icrc or (317) 232-2600.
  • Local advocacy: Fair Housing Center of Central Indiana, Indianapolis Office of Equity, Mobility & Opportunity.
  • Internal complaint: Email us directly at [email protected].

Accessibility Statement

Our ongoing commitment to making this website usable by everyone, including people with disabilities, in alignment with WCAG 2.1 Level AA.

Our Commitment

Level Up Acres LLC is committed to making its digital properties accessible to people with disabilities. We believe everyone should be able to learn about our process, request a cash offer, and contact our team — regardless of how they interact with the web. Accessibility is an ongoing effort, not a one-time achievement, and we continue to invest in improvements over time.

Conformance Standard

We aim to meet the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA, published by the World Wide Web Consortium (W3C). These guidelines explain how to make web content more accessible to people with a wide range of disabilities, including visual, hearing, cognitive, motor, and neurological impairments. Level AA is the standard generally referenced in U.S. Department of Justice guidance under the Americans with Disabilities Act (ADA).

Accessibility Features

Among the features we have implemented:

  • Semantic HTML structure with proper landmark regions and heading hierarchy.
  • Sufficient color contrast between text and background across all primary content.
  • Keyboard accessibility for navigation, forms, and interactive elements.
  • Descriptive alternative text on meaningful images.
  • Labels and ARIA attributes on form fields and controls.
  • Resizable text without loss of content or functionality up to 200%.
  • Respect for the user's prefers-reduced-motion setting — animations are reduced or removed for users who prefer that.
  • Focus indicators visible on all interactive elements.

Known Limitations

Despite our efforts, some content on the website may not yet fully meet our accessibility goals. Known areas of work include older PDF documents that may not have full accessibility tags, third-party embeds (such as scheduling calendars or form widgets) that we do not directly control but advocate with vendors to improve, and user-submitted property photos which may not have descriptive alt text.

If any limitation creates a barrier for you, please contact us — we will work to provide the information you need in an accessible alternative format.

Third-Party Content

We use a small number of third-party services (forms, scheduling, analytics) that may not be fully accessible. We choose vendors who demonstrate a commitment to accessibility and advocate for improvements where gaps exist.

Feedback & Contact

We welcome feedback on the accessibility of this website. If you encounter an accessibility barrier or have suggestions for improvement, please contact us:

We aim to acknowledge accessibility feedback within two business days and to resolve confirmed issues as quickly as practical. If you need information from this website in an alternative format (large print, audio, accessible electronic document), let us know and we will provide it at no cost.
